Acceptable Use Policy
Section 1
Scope and Acceptance
This Acceptable Use Policy ("AUP") is issued by AmoxAI, a company registered in the Netherlands, and governs access to and use of the Dropfilo file storage and sharing service, including the website at dropfilo.com, all associated APIs, and any related services (collectively, the "Service").
By accessing or using the Service — whether as an anonymous user, registered free-tier user, or paid subscriber — you ("User", "you") agree to be bound by this AUP. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to this AUP.
This AUP forms part of, and is incorporated into, the Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service.
Section 2
Permitted Uses
You may use the Service to:
- Upload, store, and share files for personal, professional, or commercial purposes, provided those files and activities comply with this AUP and all applicable laws.
- Generate and distribute share links to third parties for the purpose of transferring files.
- Access and download files shared with you through a valid Dropfilo share link.
- Manage your account, subscription, and stored transfers through the dashboard and settings interfaces.
- Integrate with the Service via any officially documented API or SDK, subject to the applicable rate limits and plan entitlements.
All permitted use is subject to the storage limits, transfer limits, and file expiry periods that apply to your plan tier (Free, Starter, or Pro), as published on the pricing page and detailed in Section 5 of this AUP.
Section 3
Prohibited Content
You must not upload, store, transmit, or distribute any content through the Service that:
- Is illegal under Dutch or EU law, or under the laws of any jurisdiction from which the content is uploaded or accessed.
- Constitutes child sexual abuse material (CSAM) or any other content that sexually exploits or depicts minors in any manner. Such content will be reported immediately to the appropriate national and EU authorities, including the Dutch National Rapporteur on Trafficking in Human Beings (BNRM) and Europol.
- Contains malware, ransomware, spyware, viruses, trojans, or any other harmful or malicious code, including code designed to damage, intercept, or gain unauthorised access to systems or data.
- Infringes intellectual property rights, including copyright, trademark, trade secret, patent, or design rights, of any third party, unless you hold a valid licence or your use falls within a statutory exception.
- Constitutes hate speech or incites violence or discrimination on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics.
- Constitutes terrorism-related material, including content that glorifies, promotes, or facilitates terrorist acts or organisations designated as such by EU or Dutch authorities.
- Violates the privacy or data protection rights of others, including unauthorised sharing of personal data, private images, or confidential communications.
- Constitutes non-consensual intimate imagery (NCII), commonly referred to as revenge porn, or any content shared without the depicted person's explicit consent.
- Constitutes fraud, phishing, social engineering, or deception, including files designed to impersonate a legitimate entity to extract credentials, financial information, or other sensitive data.
- Facilitates or promotes illegal trade or activity, including the distribution of controlled substances, counterfeit goods, illegal weapons, or stolen data.
- Constitutes spam or unsolicited bulk distribution — you must not use share links as part of mass unsolicited communications.
This list is illustrative, not exhaustive. AmoxAI reserves the right to determine in its reasonable discretion whether any content violates this AUP.
Section 4
Prohibited Conduct
In addition to prohibited content, the following conduct is strictly prohibited:
- Circumventing technical restrictions, including storage quotas, transfer limits, file size caps, and expiry periods, by any technical or procedural means.
- Creating multiple accounts (whether free or paid) to aggregate plan entitlements, evade suspensions, or otherwise abuse plan limits.
- Automated scraping, crawling, or mass downloading of files or user-generated share links not intended for public indexing.
- Denial of service attacks or any attempt to overload, disrupt, degrade, or interfere with the Service or its underlying infrastructure.
- Probing, scanning, or testing the Service for security vulnerabilities without prior written authorisation from AmoxAI.
- Reverse engineering, decompiling, or disassembling any component of the Service, except to the extent expressly permitted by applicable law.
- Selling, reselling, or sublicensing access to the Service without written authorisation from AmoxAI.
- Misrepresenting your identity or affiliation when contacting AmoxAI support or filing takedown notices.
- Accessing another user's account without authorisation, or assisting others in doing so.
- Sharing account credentials with third parties in a way that circumvents per-seat plan entitlements.
Section 5
Storage, Limits and Fair Use
Use of the Service is subject to the following plan-based limits, which may be updated from time to time on the pricing page:
- Free plan: 3 GB storage, 3 active transfers, files retained for 3 days. No payment required.
- Starter plan: 10 GB storage, 30 active transfers, files retained for 25 days. €9.99/month excl. VAT.
- Pro plan: 20 GB storage, unlimited active transfers, files retained for 60 days. €19.99/month excl. VAT.
- Anonymous uploads: Limited to 250 MB per transfer. Files are retained for 1 day. Requires no account.
Files are automatically and permanently deleted from Dropfilo's storage systems once their expiry period lapses, or when a transfer is manually deleted by the account holder. AmoxAI does not maintain backup copies of expired or deleted files and cannot restore them.
Fair use clause: Even within plan limits, you must not use the Service as a general-purpose cloud storage backup solution, a content delivery network (CDN), or a platform for automated mass distribution. If usage patterns materially exceed what a typical user of your plan tier would generate, AmoxAI may contact you and, where abuse is confirmed, limit or suspend the account.
Section 6
User Responsibility and Content Ownership
You retain full ownership of all content you upload to the Service. AmoxAI does not claim any intellectual property rights over your files. By uploading content, you grant AmoxAI a limited, non-exclusive, royalty-free licence to store, transmit, and make available your files solely to the extent necessary to operate and provide the Service.
You are solely and entirely responsible for all content you upload, store, or share via the Service. AmoxAI is a neutral hosting provider and does not proactively moderate uploaded content. However, AmoxAI acts expeditiously upon receiving valid notices of illegal content in accordance with Section 8 of this AUP and its obligations under the EU Digital Services Act (DSA) (Regulation (EU) 2022/2065).
You represent and warrant that: (a) you have all necessary rights, licences, consents, and permissions to upload and share the content you submit; (b) your content does not violate any applicable law or the rights of any third party; and (c) your use of the Service complies with this AUP in full.
Section 7
Monitoring and Enforcement
AmoxAI does not routinely monitor the content of files uploaded to the Service. However, AmoxAI reserves the right — and in some cases is legally required — to investigate, review, and act upon content where there is a credible report or reasonable suspicion of a violation of this AUP or applicable law.
AmoxAI may employ automated tools (such as known CSAM hash-matching via PhotoDNA or equivalent) to detect specific categories of illegal content without reviewing individual file contents, in compliance with EU interim regulation (EU) 2021/1232 and any subsequent legislation. Such automated scanning does not constitute general monitoring.
Where AmoxAI becomes aware of illegal content, it will act promptly to remove or disable access to that content, and will report to competent authorities where required by law. AmoxAI will notify affected users of enforcement actions where legally permitted to do so.
Section 8
Notice and Takedown Procedure
AmoxAI operates a Notice and Takedown (NTD) procedure in compliance with Article 16 of the EU Digital Services Act. If you believe that content stored or shared via the Service is illegal or violates this AUP, you may submit a notice to AmoxAI using the contact details in Section 13.
A valid notice should include the following information:
- Your name and contact information (email address required).
- The specific URL(s) or share link(s) referencing the content in question.
- A clear explanation of why you believe the content is illegal or violates this AUP, with reference to specific legal provisions where applicable.
- A declaration that the information provided is accurate and complete to the best of your knowledge.
- Where the notice relates to copyright infringement: confirmation that you are the rights holder or authorised to act on behalf of the rights holder.
AmoxAI will acknowledge receipt of valid notices and process them in a timely manner — typically within 72 hours for non-urgent matters and as soon as reasonably possible for content involving imminent harm or CSAM.
Where content is removed or access is disabled following a notice, AmoxAI will inform the user who uploaded the content (where their identity is known and disclosure is legally permitted), except where doing so would obstruct law enforcement investigations or create a risk of harm.
AmoxAI maintains an internal complaint-handling system for users who believe a content moderation decision was erroneous. Users may appeal enforcement decisions by contacting AmoxAI at the address in Section 13, setting out the grounds for appeal.
Section 9
Copyright and Intellectual Property
AmoxAI respects intellectual property rights. If you believe that content on the Service infringes your copyright, please submit a written notice to AmoxAI at the contact details in Section 13. Your notice should include:
- Identification of the copyrighted work claimed to have been infringed.
- The URL or share link to the allegedly infringing content.
- Your contact information.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner.
AmoxAI operates in compliance with applicable EU copyright law, including Directive 2001/29/EC on the harmonisation of certain aspects of copyright and related rights in the information society.
Repeat infringers: AmoxAI maintains a policy of terminating the accounts of users who are found to be repeat infringers of third-party intellectual property rights.
Section 10
Suspension and Termination
AmoxAI reserves the right to suspend or permanently terminate access to the Service, with or without prior notice, for any user or account that:
- Violates any provision of this AUP.
- Violates the Terms of Service or any other agreement with AmoxAI.
- Engages in conduct that is harmful to the Service, its infrastructure, or other users.
- Is subject to a valid court order or law enforcement request requiring suspension or termination.
Where legally permitted, AmoxAI will provide reasonable notice prior to suspension or termination, except in cases where immediate action is necessary to prevent harm, address security incidents, or comply with a legal obligation.
Effect of termination: Upon termination of your account, all your files and transfer data will be permanently deleted from the Service. Paid subscriptions will not be prorated or refunded except as required by applicable consumer law, including the Dutch Civil Code (Burgerlijk Wetboek) and EU consumer protection directives.
Suspended or terminated users who believe the action was taken in error may appeal by contacting AmoxAI at the address in Section 13.
Section 11
Changes to This Policy
AmoxAI may update this AUP from time to time to reflect changes in the Service, legal requirements, or industry standards. When we make material changes, we will update the "Last updated" date at the top of this page.
For registered users, AmoxAI will provide reasonable notice of material changes by email or via a prominent notice in the dashboard. Continued use of the Service after the effective date of a revised AUP constitutes your acceptance of the updated terms.
We encourage you to review this AUP periodically. If you do not agree to a revised AUP, you must stop using the Service and may delete your account via the dashboard settings.
Section 12
Governing Law and Jurisdiction
This AUP and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Subject to any mandatory consumer law protections applicable in your country of residence, any dispute arising out of or in connection with this AUP shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
Nothing in this AUP limits the rights you have under applicable mandatory national consumer protection laws or the law of your country of habitual residence as an EU consumer.
